New Pool Leak

I had a new 24 ft. pool installed. After pool was filled and we noticed that there is a leak. The installer insists that it has to be a hole in the liner and we now have to deal with where we bought it. What is the pool retailer responsible for? Obviuosly they need to provide for the installation a new liner. Are they responsible with draining the pool? Are they responsible for my costs to fill the pool?
