New pool question

New 30K gallon vanishing edge pool, 40' x 20' with 2-HP Hayward Super and Hayward 175 sq. ft filter. Water is drawn from pool drain and surge tank. No dedicated overflow pump. Ball valve on main drain is partially closed in effort to maximize flow over weir wall. I contend filter is obviously waaaay too small by any standard, even if there were an overflow pump. Builder says I'm wrong, all if fine. What do you think?
